Accepting these terms
These terms govern your use of the Paaking app, the Paaking website, and the services Paaking provides ("Paaking" or the "Service"). By creating an account or using the Service, you agree to these terms. If you don't agree, don't use the Service.
Eligibility
You must be at least 18 years old, hold a valid driver's license (to use as a parker), and have the legal capacity to enter into binding contracts.
Your account
You are responsible for the security of your account credentials and for everything that happens under your account. Notify us immediately at security@paaking.app if you suspect unauthorized access. You must provide accurate information about yourself and your vehicles and keep it up to date.
The marketplace
Paaking is a marketplace that connects people with parking spaces ("hosts") to people seeking parking ("parkers"). Paaking is not a party to any parking transaction. We do not own, control, manage, inspect, or guarantee the safety of any listed parking space. Hosts list at their own discretion; parkers book at their own risk.
Parker terms
- You may only book a spot for the vehicle you have added to your profile.
- You are responsible for following all posted rules, local laws, and time limits at the parking location.
- You must end your parking session promptly when you leave. If you exceed your booked end time, you may be charged for the additional time.
- You are responsible for any damage you cause to the property of the host or third parties.
Host terms
- You represent that you own the parking space you list or have the legal right to license it for parking under these terms.
- You are responsible for compliance with all applicable local, state, and federal laws, including zoning, HOA rules, lease agreements, and tax obligations on income earned.
- Pricing and availability are set by you. We do not guarantee any minimum earnings.
- You may not list a space you do not control, nor one whose use as paid parking violates any agreement you are bound by.
Payments
All payments are processed by Stripe. By submitting payment information, you agree to Stripe's terms. Host payouts are made via Stripe Connect, which has its own onboarding requirements and identity checks. Paaking retains a service fee on each transaction, as disclosed at the time of booking.
Cancellations & refunds
Cancellation rules are shown at the time of booking. We are not obligated to refund a session you actually parked for. If a host's spot turns out to be unusable (blocked, missing, unsafe), contact support and we will work with both parties to resolve it, including issuing a refund in our discretion.
Acceptable use
You will not:
- Use Paaking for any illegal purpose.
- Misrepresent your identity, vehicle, or right to a parking space.
- Interfere with the operation of the Service or attempt to access it through anything other than the published clients.
- Harass, threaten, or harm hosts or other parkers.
- Use Paaking to facilitate any activity that violates the rights of others.
User content
You retain ownership of content you upload (photos, descriptions, etc.). By uploading, you grant Paaking a non-exclusive, worldwide license to host, store, display, and transmit that content for the purpose of operating the Service.
Intellectual property
The Service, including the Paaking name, logo, and software, is owned by Paaking Inc. and protected by copyright, trademark, and other laws. Nothing in these terms grants you any right to use Paaking's marks outside the limited license to use the Service.
Disclaimers
The Service is provided "as is" without warranties of any kind, express or implied. Paaking does not warrant the accuracy of listings, the safety or condition of any parking space, the conduct of any user, or that the Service will be uninterrupted or error-free. Use of the Service is at your own risk.
Limitation of liability
To the maximum extent permitted by law, Paaking will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or related to your use of the Service. Paaking's total liability for any claim arising out of or related to the Service is limited to the greater of (a) the amount you paid us in the twelve months prior to the claim or (b) US$100.
Indemnity
You agree to indemnify and hold harmless Paaking, its affiliates, officers, and employees from any claims, damages, and expenses arising out of your use of the Service, your content, your breach of these terms, or your violation of any law or the rights of a third party.
Disputes
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved through support will be brought in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of those courts.
You and Paaking agree to bring any claim only on an individual basis, not as a plaintiff or class member in any purported class or representative action.
Termination
You may delete your account at any time. We may suspend or terminate your access to the Service if you violate these terms or if we reasonably believe continued access poses a risk to other users.
Changes to these terms
We may update these terms. If we make a material change we will notify you in-app or by email before it takes effect. Your continued use after the change constitutes acceptance.
